Terms of Service
Agreement
By engaging OUTBOUND Design ("we", "us") for web design, development, or marketing services, you ("the Client") agree to the following terms. These terms apply to all work unless a separate written agreement is in place.
Services
We provide website design, development, hosting setup, booking system integration, SEO, and marketing automation services. The specific scope of work for each project is agreed in writing (via email or proposal) before work begins.
Quotes and payment
- All quotes are valid for 14 days from the date issued
- A 50% deposit is required before work begins
- The remaining balance is due upon project completion, before the site goes live
- Payments are processed via Stripe or direct bank transfer
- All prices are in Australian dollars and include GST where applicable
Project timeline
We'll provide an estimated timeline at the start of each project. Timelines depend on prompt feedback and content delivery from the Client. Delays caused by late content or feedback may extend the project timeline.
Revisions
Each project includes a reasonable number of revisions as outlined in your proposal. Additional revisions beyond the agreed scope will be quoted separately. "Revisions" means changes to the agreed design — not a complete redesign or change of direction.
Content
The Client is responsible for providing all text content, images, logos, and brand assets needed for the project. If content is not provided within 14 days of request, we may use placeholder content to maintain the project timeline.
We may source stock photography or generate AI imagery where agreed. The Client warrants that all content provided is owned by them or properly licensed.
Intellectual property
- Client content — text, logos, images, and brand assets remain the property of the Client
- Website code — upon full payment, the Client receives full ownership of the custom code written for their project
- Third-party assets — fonts, stock images, and third-party tools are subject to their own licence terms
- Portfolio rights — we reserve the right to showcase completed work in our portfolio and marketing materials unless otherwise agreed in writing
Hosting and domains
We can set up hosting on Vercel or a similar platform. Hosting costs are the Client's responsibility after handover. Domain registration and renewal are the Client's responsibility — we can assist with setup but do not manage domains long-term.
Ongoing support
After launch, we offer ad-hoc support at our standard hourly rate. Support requests are handled during business hours (Mon-Fri, 9am-5pm AWST). We do not provide 24/7 monitoring or emergency support unless a separate maintenance agreement is in place.
Cancellation
- The Client may cancel at any time by providing written notice
- If cancelled after work has begun, the deposit is non-refundable
- Work completed up to the point of cancellation will be invoiced at our standard rate
- Any materials or code produced remain the property of OUTBOUND Design until full payment is received
Liability
We take pride in our work but are not liable for:
- Loss of business, revenue, or data arising from the use of our services
- Third-party service outages (hosting, payment processors, etc.)
- Issues caused by Client modifications to the delivered work
- SEO results — while we follow best practices, search rankings are influenced by many factors outside our control
Our total liability for any project is limited to the amount paid by the Client for that project.
Confidentiality
We treat all Client information as confidential. We won't share your business details, strategies, or project specifics with third parties without your permission — except where required by law.
Governing law
These terms are governed by the laws of Western Australia. Any disputes will be resolved in the courts of Western Australia.
Changes
We may update these terms from time to time. Changes won't apply to projects already in progress unless both parties agree in writing.
